Removal of the elected officials of Nasinu Branch League


Nasinu Branch officials resigned from their posts in a Council Meeting which was held at Magania Nadi reason being; allegations were made against Nasinu Branch by the corrupt secretary Taabesh Akbar (evidence will be attached soon) and then the Council adapted a corrupt practice to investigate and did not allow Nasinu Branch to defend. The branch officials thought it was appropriate to leave the Council meeting since the Council meeting was bias and led by munafiqs. After Nasinu Branch officials had left the meeting the Council decided that Nasinu Branch officials would be suspended. The constitution ruling on this incident was that the moving out of the Nasinu Branch officials was itself a dispute and the matter should have gone to the dispute resolution committee first, then to the working committee and then back to the Council to make a resolution. On every occasion Nasinu Branch officials should have been invited and a proper and full investigation should have been carried out by the officials but instead Hafiz Khan himself decided to pay almost $12,000.00 from Nasinu Muslim Canteen account and pay a solicitor in Suva to take the officials to Court.

The current interim committee appointed by the corrupt officials of FML is totally unconstitutional and breaks all the rules set for affiliation. Those who were appointed in the interim were always against Nasinu Branch League and the financial status of Nasinu Branch League is a disaster. (More information)


The only way forward to get the branch league out of the grasp of these munafiqs is:

1- Either we all Muslims in Fiji put a stand and remove this corrupt regime of FML.

2- To break the affiliation from FML and get all our properties back to Nasinu Muslim League which was unlawfully transferred initially.

 This is not a difficult task since if majority member of Nasinu Branch sign for this we can break the affiliation and get our properties back and this will also cost almost $15,000.00 in legal fees. But the benefits of this would be huge such as we would have our land back and with donors ready we can build a brand new girls College. Also we can easily afford to run the primary school totally free of charge. There are many more things we can achieve but our donors are not prepared to spend a single penny while the corrupt regime of FML is still here.  

Nasinu Branch League has assets of over 4 million dollars which is the total contribution and hard work of the elders and our brothers and sisters of Nasinu, none of this has come from FML. To date FML has never contributed even a cent to the creation of Nasinu Muslim Leagues assets.



Court Proceedings on the Removal of Nasinu Branch League


The corrupt trustees decided to take Nasinu Muslim League officials to court at a cost of almost $35,000.00 which was forcefully funded by Nasinu Branch League. This money could have been used to upgrade our schools. As per the Constitution of Nasinu Muslim League the matter should have gone through clause 85 first before going to court but these munafiq trustees had nothing to loose and they went ahead for a court action. As per the Constitution of Fiji Muslim League these officials should be suspended for a period of no less than seven years. An application was made by the trustees of Fiji Muslim League on 17th September 2007. Copy of the Court application, defence by Nasinu Branch and the judgement can be found below. We disagree with the judgement and discrepancies in the judgement from our perspective are as follows:


1- The application does not relate the entire issue as narrated in the Judgement, so the question remains where did Justice Jiten obtain these information from.


2- As per paragraph one in the judgement, Justice Jiten writes that the officials of Nasinu Branch were removed. Here he never went further to see if the removal was actually carried out, and the answer is NO! He also did not bother to investigate or follow that such a removal should be dealt under clause 84 of the Constitution of FML and the fact remains there was never an investigation done as to why the branch officials walked out of the Council Meeting dated 12-08-2007.


3- Justice Jiten never bothered to investigate or to check the ruling at the Council Meeting where the branch members were suspended, the presence of the officials of Nasinu Branch.


4- Even though the Council has powers to suspend any official or management with or without motions but in any situation the branch officials need to be present on such a Council Meetng.


5- Justice Jiten failed to investigate whether the officials were present or not in the Council meeting where they were allegedly suspended. Justice Jiten also accuses that the Branch members were given enough time to respond to the special committee and that the Branch League seeked a postponement of 14 days. This is a blatant LIE by Justice Jiten Singh as he knew through our defense that the Council ruling was to investigate within 14 days and to investigate 47 counts of allegations’ where on the minutes of FML dated 12-08-2007 there chairman of the investigation committee could not honor the council rulings of 14 days because of his personal reasons furthermore the chairman of the committee also admits that he started his investigation after a month. All further details are in our defense. (The fact remains that no actual investigation was ever carried out on the 47 counts of allegations to date and Nasinu Branch League never sought any time extension of 14 days of the Council ruling dated 12-08-2007. The extension time was requested after the chairperson wrote to investigate which was a month after the Councils standing order and details were all given to Justice Jiten Singh in our defense).


6- So as per Justice Jiten’s judgement dated 29-02-2008 he can pass a decision on a accused in his court without a hearing (the Council alleged suspension was done without the invitation and presence of Nasinu Branch Officials).


7- Justice Jiten failed to investigate if the Council had followed proper procedures for suspension that was to invite the officials who had walked out of the Council meeting, give them a fair trial, let them present their reasons for walking out of the council meeting dated 12-08-2007 and give them a chance to submit their defense.


8- Justice Jiten Singh failed to investigate that whether the special appointment of the Special Committee Committee was appointed by the Council or if the appointment was made by the speaker himself. He even further failed to investigate who were the actual members of the Special Investigation Committee (members of the investigation committee were the members of the Fiji Muslims League Management Committee or in other words part of the plaintiffs.


9- Justice Jiten failed to investigate whether or not the Members of Nasinu Branch were given natural justice.



Paragraph 10 of the judgement were Justice Jiten Singh agrees that section 64 of the constitution over-rides section 84 of the FML constitution. But he fails to acknowledge why section was 84 not adopted and he further failed to investigate that whether there was a motion from the floor of the Council to adopt section 64. He even fails to understand that the Council of FML does not have the powers to over-ride any part of the Constitution of FML at anytime.


Paragraph 12 where Justice Jiten’s views that the League had powers to remove the branch but he has not indicated on his view that proper procedures are to be followed and documentary evidences are to be provided to make a judgement. He also claims that the defendants were given opportunity to be heard, here you can clearly see that Justice Jiten failed to consider our defense where we have clearly given evidence that we were not given any fare opportunities to do so.


Justice Jiten Singh has mixed two issues on his judgement as follows:


1- The Council meeting on 12-08-2007 only discussed the issue of the 47 allegations.


2- There was no special Council Meeting for the suspension of the Nasinu Branch Officials.


On the Council meeting 12-08-2007 the branch officials walked out of the Council meeting which has been confirmed by the minutes of FML. So that clearly indicates there was no discussion made regarding the suspension of Nasinu Branch League.


in Paragraph 4 Justice Jiten Singh admits he is basically enforcing the Councils decisions again failing to investigate the Councils integrity and allowing natural justice for the defendant.


From the judgement we have calculated that Justice Jiten’s bias judgement has failed to allow natural justice to the defendants, has cost Nasinu Branch League almost $5 million dollars in damages. Divided Muslim of Nasinu Branch League and restricted Nasinu Branch League members from entering mosques which is under the name of FML. I urge all brothers and sisters to see the truth about the removal of the officials of Nasinu Branch League.


Why Justice Jiten Singh gave a biased and unlawful judgement is only best known by him and FML. If there was a financial gain or not is also best known by him but there is no doubt that he has caused millions of  dollars worth of damages to Fiji Muslims League and Muslims of Fiji at large. Nasinu Branch Officials voted not to appeal the judgement as the discrepancies in Justice Jitens judgement baffled us . All the corruption of FML is also with FICAC from the past 4 years but for reasons best known to them they have not taken any action on this matter nor have they investigated it. Our fight with the corrupt officials with Fiji Muslim League is still there and we have found a way to keep pushing forward. We will get all our schools and mosques back from these munafiqs INSHA-ALLAH one day.


Removal of Maulana Imran Patel

The darkest day in the history of Nasinu Muslim League was when Maulana Imran Patel was forced to leave Koronivia Masjid. Maulana Imran Patels  arrival, wages and most living costs were beared by most of the permanent members of Nasinu Branch and only at a later stage did Nasinu Branch pay for his wages. The immigration also acted unlawfully on his issue but the fact remains we invited him to work for us and he signed a contract which was also approved by FML. Maulana left his work in India which took him almost 15 years to get to his position. He complied 100% + his wife was Alima with a teaching experience of six years and provided services to our sisters free of charge. Maulana Imran was told to sign another contract which also included cleaning of all toilets and he would be transferred wherever the FML officials would want but the Nasinu Branch Officials objected this and advised him not to sign this as it was unislamic and illegal.


Maulana Imran already had a contract and on that contract he was given a work permit where he was not allowed to enter in any other contracts. At the end Nasinu Branch canteen account was used to pay $15,000.00 in costs which only the FML officials know about. More information about this will be available shortly.



Importation of Vehicle for Tableegh and Dawah


I duty free vehcile was imported by Nasinu Branch League, vehicle number: FF652 which is registered under Nasinnu Branch League and the sole property of the members of Nasinu Muslim League. This vehicle was first approved in the branch management committee and a proper duty free concession was approved by the Government. A letter was sent to Fiji Muslim League for any objection (no objection was noted until such time the vehicle was imported and being used). Lastly a notice of approvals and intention of importation of the said vehicle was on the notice board three months prior to its importation. I suggestion box was provided for suggestions but no objections or suggestions were received. The entire purchase was funded by members of Nasinu Branch League, a member from Suva Muslim League and brothers and sisters from New Zealand. Most of the monies were personally collected by myself and the last elected President of Nasinu Branch League brother Haji Mumtaz Ghani and every donor was individually told that construction of musafiq khana for jamaat and vehicle will be imported for tableegh. Money then was deposited in the general account of Nasinu Branch League and a cheque was written to pay for all the importation costs. A $30,000.00 vehicle has costed less then half to Nasinu Branch League ($8,000.00 was only paid by the Branch League) but unfortunaltey due to a few munafiq members of Nasinu Branch League and of munafiqs in the management of FML obtained a fatwa from Macauta Muslim League and presented it in the council meetings to confiscate the vehicle and operate the vehicle at the headquarters. These actions were carried out by members who are anti Tableegh and anti Prophet Muhammed (SAW). I as the last ever elected secretary of Nasinu Branch League carried out proper procedures for the importation of this vehicle with full concern and support of the members of Nasinu Branch League.


With the help of the most corrupt ever and unconstitutionally elected speaker of FML, Faizal and Faiyaz Koya rulled against Nasinu Branch League on the issue on this vehicle and since then this vehicle has been mis-used by Hafiz Khan himself and his close agent and cousin Shameem who is also a staff at the headquarters of FML.



Mortgage or Primary School by Hafiz Khan


Hafiz Khan, the man who sells pork and alcohol for a living and the unconstitutionally elected president of FML has mortgaged for thousands of dollars. None of the Nasinu Branch members or officials knew about where the money from this mortgage went to and just because of this the entire umah of Nasinu is involved in this haraam and sinful action. All will be punished for obtaining and being part of ribah (interest) on the day of judgement. There was never a proper working committee or council approval for all of these and the fact remains that Nasinu Branch League cannot obtain funding on interest, this is unconstitutional. The lender Westpac Banking Corporation has mortgaged these properties which is against the constitution and their decision will be challenged.  



Pending Motions


On the 27th July, 2006 there were seven motions moved by Nasinu Branch League at the Council of FML as per the constitution of FML. To date no motions have been tabled or addressed, the management of FML on the instructions of Hafiz Khan failed to comply with the constitutions. They were afraid that all the facts would be presented in front of everyone and they would be suspended for life. This is a serious breach of affiliated constitution and there is no doubt these will be used when we file a law suite against FML and withdraw the affiliation to get all our properties back under Nasinu Muslim League. The bank balance of Nasinu Branch was almost $200,000.00 when we left but in the last 3 years the current and unlawful management have misused all the funds and most of the accounts are running on overdraft. This is what Hafiz Khan and his colleagues wanted, to obtained every single penny from where ever they could to fund their unlawful and corrupt regime.


Board of Governors


On 21/07/2002, there was a resolution passed at a council meeting to establish a board of Governors for Nasinu Muslim Schools, again the corrupt council of FML carried out these unlawful actions since there is nothing such as board of governors to be established in the affiliated constitution. In order to obtain more folding cash out of the then richest Branch League they devised this unlawful board. I am not sure how much cash the speaker of the day took under the table to rule in their favor but insha-allah I will find out very soon. Until the matter is decided before courts we will have to follow the rulings of the council where it clearly states that six shall be nominated by the branch and four shall be appointed by the National President out of which two shall be independent. The new board shall draw its own rules and regulations and the funds should be managed by the Branch League always.



If you look at the current board members appointed by Hafiz Khan you will realize that there is no one from the elected Nasinu branch League. The most important issue is that the funds are being controlled by the pork seller Hafiz Khan himself. If you see the current financial's of Nasinu Muslim schools are on a verge of bankruptcy and we may have to sell some of the properties to pay off the debt, either Koronivia Mosque, Primary school or the College.



$500,000.00 School Manager Corruption


On 12-08-2007 in a Council meeting of FML the corrupt Hafiz Khan, Tabeesh Akbar and Nisaar Ahmad were trying to get an approval to appoint a paid school manager for Fiji Muslim League Schools. They intended to pay the school manager $100,000.00/ annum payable by all five colleges in branch leagues. Out of this $100,000.00 we do not know how much would have been pocketed by these three corrupt officials of FML. But we are grateful to the elected officials of Nasinu Branch who objected strongly and told these three trustees that such unethical and corrupt actions are against the constitution and we opposed the Council against making any such decision. The Council agreed there will not be any such paid school manager for schools. To date Fiji Muslim League has saved $500,000.00 in cash! We can clearly see the intentions Hafiz Khan has by leading FML and there are countless other issues where Hafiz Khan has and is misusing his position and is making personal gains. From my estimation Fiji Muslim League has lost more than $9 Millions dollars in cash and kind since Hafiz Khan took the office. This corrupt person with all his friends needs to be kicked out of the office with a Munafiq label.



A. Mishra and Company/ Corrupted Audited Accounts


Please have a look at the documents below, if Mr. Mishra had any truth or honesty on his audited accounts of Nasinu Branch League why to date none of his accounts were presented on Annual General Meetings of Nasinu Branch League. It wont be long before we will be filing matters before courts against such unjustified chartered Accountants in Suva. At this stage I am not sure why Mr. Mishra favored FML in his auditing of Nasinu Branch League accounts.
